Court Says Mall Can't Regulate What Shoppers Talk About

We sure as heck don't have that problem here. We got no malls.

If you consider the Greendale Mall a mall, then my point is made. Hey, maybe the reason The Greendale Mall is dead (and The Galleria long gone), folks just didn't know what to say to each other while promenading the retail temple.

But the Roseville Mall in CA sure as heck knew what they didn't want. According to the article, the specific rule at issue prohibits a person in the center's common areas from "approaching patrons with whom he or she was not previously acquainted for the purpose of communicating with them on a topic unrelated to the business interests" of the mall or its tenants. Um... sounds sorta like the relationship the citizens have with the Shitty Council.

The Sacramento Bee reports: Owners of the Westfield Galleria at Roseville didn't want strangers talking to each other if they weren't talking about the mall. They even had rules to enforce that behavior, but a state appellate court has starkly declared that the mall's attempt to regulate conversation is unconstitutional. A three-judge panel of the 3rd District Court of Appeal said Wednesday in a 43-page opinion that the company's rules of conduct "are unconstitutional on their face" under the California Constitution's free speech guarantee.
